TERMS AND CONDITIONS

  1. The renter shall collect and return the bicycles and rented equipment on the agreed date and time at the facilities of Rund and Bike. In the event of failure to return the rented products on the date specified in the contract, an additional charge equal to twice the daily rental rate will apply. If the product is not returned, the lessor shall have the right to immediately reclaim possession of the bicycle, wherever it may be located, without the renter having any right to make a complaint or claim. Should the renter return the rented bicycle before the agreed date, the lessor reserves the right not to refund the amount paid for the unused rental days.
    Prepaid reservations may be cancelled free of charge up to 48 hours before the start of the rental period. Cancellations made up to 24 hours before the start of the rental period will incur a penalty equal to 50% of the reservation cost, and cancellations made within 24 hours of the start of the rental period will not be refunded.
  2. The bicycle is delivered in perfect working condition, including any authorized accessories and equipment. The renter must return all equipment in the same condition in which it was received. Any complaints regarding the condition of the bicycle must be made before collecting the rented bicycle. The cost of repairing or replacing the bicycle and/or equipment shall be borne by the renter, who must report any damage or malfunction to the lessor.
  3. The renter shall take all necessary measures to prevent theft, loss, robbery, or damage to the bicycle and rented equipment. In the event that any of the aforementioned circumstances occur during the rental period, the customer/renter shall be fully responsible and must immediately cover the full cost of replacement by paying the value of the item at its purchase or market price.
    In this regard, the customer/renter hereby authorizes the company to charge their credit card for an amount equivalent to the damage caused to the bicycle and, in the event of theft or loss, for the value of the item at its purchase or market price.
    At the end of the rental agreement, the lessor shall determine the conditions for the return of the rented equipment and, if applicable, assess any loss or damage to it.
    In the case of a guided tour or activity, it is mandatory to follow the instructions provided by the company’s staff. Failure to do so will make the customer responsible for any material or personal damage or injury that may result.
    Run and Bike reserves the right to modify or cancel any organized activity due to adverse weather conditions or circumstances beyond its control.
  4. The rental of a bicycle or participation in an excursion activity does not include insurance coverage for personal injury. Therefore, the renter is responsible for all material and personal damages that may result.
  5. The renter declares to be over 18 years of age and to possess full physical and mental capacity, as well as to be in good health, to have sufficient knowledge and experience to use the rented equipment, and acknowledges that such activity is carried out at the renter’s own risk and responsibility.
    The renter declares that the lessor has been duly informed of any medical or psychological conditions the renter may suffer from. The company shall not be held liable for any accidents, material damage, or personal injury that the renter may sustain as a result of this activity.
  6. The renter shall provide the lessor with a security deposit, paid by credit card or in cash, to cover any damage to the bicycle or rented equipment. This deposit will be returned to the renter upon the expiration of the rental agreement.
    In the event of an accident, damage, loss, or theft of the bicycle, the renter must immediately notify Run and Bike by calling the number +39 031 48 96 050— thereby forfeiting any right to request the return of the security deposit, as well as any refund or compensation for unused rental days. Furthermore, the lessor shall be compensated in the amount agreed upon by the parties, as specified in clause 3.
    The rented bicycle may be used exclusively by the renter, unless Run and Bike has been duly informed of its use by third parties, who shall be specifically identified in the annex to this agreement. The renter shall be responsible for any actions carried out by such third parties and must inform them of the terms and conditions of this contract.
    The renter may not transfer, sell, mortgage, exchange, or sublet the bicycle or any part of it, including any tools or accessories provided with it.
  7. Improper use of the bicycle is strictly prohibited. The installation of accessories or items on the rented bicycle is permitted only if such items are installed and removed by Run and Bike mechanics.
    Likewise, the use of the bicycle for amateur or professional races is prohibited without prior authorization from the lessor.
    The renter and any accompanying persons are responsible for complying with traffic regulations. Wearing a helmet is mandatory when cycling outside urban areas, and the use of front and rear lights is required.
  8. The information provided by the customer will be used exclusively for the proper delivery of the purchased service, in accordance with the provisions outlined in the Privacy Policy.
  9. The customer declares to have read, listened to, understood, and asked all relevant questions regarding the specific use of the rented equipment, as well as the essential safety, behavioral, and environmental guidelines provided by the organization at the time of delivery of the rented equipment.
  10. This agreement is governed by Italian law, and the customer accepts its principles and conditions. The signed terms apply to all facilities and excursions organized by Run and Bike. Any dispute arising from the execution of this agreement shall be submitted to the courts of Como, and the parties involved shall be subject to their jurisdiction.
